1.2 User and Service Provider Agreement (Booking Contract)

When you complete a booking, you enter into a direct, legally binding contract with the Service Provider responsible for your booking.

YatraDham.Org is not a party to this Booking Contract and does not provide the underlying service itself, but the Platform facilitates the booking and payment process on behalf of the Service Provider. You must review and accept all applicable Service Provider policies prior to confirming your booking.

You warrant that you are at least 18 years old and legally competent to enter into binding contracts to book and use the Services independently. Users under 18 may only browse or use the Platform under parental or legal guardian supervision using their registered account. We reserve the right to suspend or terminate access without notice if this is not adhered to. This also applies to fraudulent or abusive conduct.

4.1 To utilize most Services, you must create an Account on the Platform by providing accurate, truthful, and current information. You are responsible for safeguarding your login credentials and all activity occurring under your Account.

4.2 You agree to notify us immediately of any unauthorized use of your Account or any security breach. Failure to do so may lead to liability for losses incurred. Account sharing or unauthorized access is strictly prohibited unless authorized by us.

4.3 Limited features may be accessible without registration; however, bookings require a registered Account.

5.1 User-Platform Agreement: By using the Platform, you enter into an agreement with YatraDham.Org governing your use of the Platform services, including booking facilitation, payments, account management, and communications.

5.2 By submitting a booking request, you make an offer to contract directly with the listed Service Provider on the terms provided in the booking details. Confirmation is subject to acceptance by the Service Provider.

5.3 User-Service Provider Agreement: When your booking is confirmed, you enter a direct, legally binding contract with the third-party Service Provider responsible for delivering the booked service(s). This contract governs your obligations for payment and your right to receive the service.

5.4 A binding Contract comes into effect only when the Service Provider accepts your booking request, usually confirmed by a confirmation email or voucher issued via YatraDham.Org. Once confirmed, you obtain the right to use the service as agreed with the Service Provider, including occupancy rights, access to amenities, and any additional terms stipulated by the Service Provider.

5.5 Booking acceptance and confirmation are subject to availability and approval by the Service Provider. Confirmation will be sent via email or app notification, including booking details and confirmation vouchers.

5.6 You must comply with the Service Provider's terms and policies, including those relating to cancellations, refunds, check-in, and other service conditions. You are solely responsible for complying with the Service Provider's rules during your stay or use of the service. That Details are available on each product page.

5.7 We reserve the right to cancel or reject bookings at our sole discretion or on behalf of a Service Provider without liability. Refunds, if applicable, will be handled pursuant to disclosed refund policies.

6.1 Payment terms (including amounts, payment timing, and refund policies) are governed by the Service Provider's policies and are communicated during the booking process. You agree to pay all amounts as specified.

6.2 YatraDham.Org may facilitate payment collection and remit funds to the Service Provider, but does not accept liability for Service Provider performance.

6.3 Cancellation, modification, and refund procedures are subject to the Service Provider's policies detailed in your booking confirmation. YatraDham.Org is not liable for penalties arising from cancellations or disputes with Service Providers.

6.4 All payment obligations, including booking amounts, applicable taxes, fees, and charges, are payable as described at the time of booking. Payments are generally processed via third-party payment gateways.

6.5 YatraDham.Org does not control payment processors and disclaims liability for delays, errors, or failures in processing. You are responsible for using a valid payment method with sufficient funds.

6.6 You bear sole responsibility for any unauthorized or fraudulent use of your payment instruments, except where prohibited by law.

6.7 Additional taxes, fees, or government charges introduced after booking may be payable directly to the Service Provider.

6.8 Currency conversion fees or cross-border transaction charges may apply and are your responsibility.

6.9 Any convenience or service fees charged by YatraDham.Org will be transparently disclosed during booking.

7.1 Cancellation and refund terms vary by Service Provider and booking type and will be disclosed during the booking process.

7.2 Certain bookings may be non-refundable or subject to cancellation fees; you are responsible for reviewing and complying with such policies before booking.

7.3 Any changes or cancellations must be made in accordance with Service Provider policies. Service fees may apply for modifications or cancellations processed through the Platform.

7.4 Refund processing times depend on payment providers and currency factors and method of use during the payments.

7.5 YatraDham.Org may modify cancellation policies or terms for specific Properties or Services, with appropriate disclosure or without prior notice.

You agree to use the Platform lawfully and in good faith, refraining from any prohibited conduct, including but not limited to:

• Providing false, misleading, or fraudulent information
• Attempting unauthorized access or interfering with the Platform or other users' accounts
• Uploading viruses or malicious software
• Violating intellectual property or privacy rights
• Using automated systems (bots, scrapers) to extract data
• Harassment, impersonation, or abusive behaviour

9.1 All Platform content, including text, graphics, logos, software, and branding ("Platform Content") is owned or licensed or fair use or permitted use by YatraDham.Org and protected by law.

9.2 You may use Platform Content for personal, non-commercial purposes only, without alteration or distribution.

9.3 Content you submit (reviews, feedback, images) grants YatraDham.Org a worldwide, royalty-free license to use and display such content. You warrant you have rights to such content and it does not infringe third-party rights.

10.1 Use of your personal data is governed by our Privacy Policy, incorporated herein. Learn more on our Platform.

10.2 Electronic communications, including booking confirmations, updates, and marketing, may be sent to you. Marketing opt-outs are possible, but transactional communications are mandatory.

10.3 We endeavour to protect your data confidentiality, but we cannot guarantee the security of data transmitted via the internet. You accept transmission risks.

10.4 Our Platform uses cookies and tracking technologies. You can manage cookie preferences via your browser or Platform settings.

11.1 Your relationship with YatraDham.Org is limited to Platform use and booking facilitation. YatraDham.Org does not guarantee or supply booked Services and is not responsible for Service Provider acts, omissions, or performance.

11.2 To the fullest extent permitted by law, YatraDham.Org disclaims all warranties related to the Platform and Service Provider services.

11.3 YatraDham.Org's liability for any claims related to Platform use is limited to fees paid to YatraDham.Org for facilitation services relating to the claim.

11.4 The Platform and Services are provided "as is" without warranties of any kind, express or implied.

11.5 We disclaim liability for:

• Service Provider or User acts, omissions, or breaches
• Losses, damages, or disruptions arising from use or inability to use the Platform or Services
• Third-party fraud, unauthorized access, or technical failures

11.6 We are not liable for force majeure events (natural disasters, pandemics, government actions, etc.).

You agree to indemnify, defend, and hold harmless YatraDham.Org, its affiliates, officers, employees, and agents from any claims, losses, or damages arising from your violation of these Terms or misuse of the Platform.

We may suspend or terminate your access for breaches or lawful reasons without notice. You may close your Account by contacting us. Termination does not affect accrued rights or obligations.

The Platform may contain links to third-party sites. We do not endorse or control these and are not responsible for their content or practices. Use them at your own risk.

These Terms and your use of the Platform are governed by the laws of India. Disputes will be subject to the exclusive jurisdiction of courts in Bhavnagar, Gujarat, India. You consent to such jurisdiction and waive objections to venue.

16.1 No waiver of any breach grants waiver of future breaches.

16.2 If any provision is unenforceable, the remainder remains effective.

16.3 These Terms and associated policies constitute the entire agreement between you and YatraDham.Org regarding Platform and Services use.
